FOI disclosure log policy

The Department’s Freedom of Information (FOI) disclosure log contains documents released following an FOI access request and which are available for public access.

The Department is required under the FOI Act 1982 to publish a disclosure log on its website. The disclosure log lists information which has been released in response to FOI access requests since May 2011.

The disclosure log requirement does not apply to:

  • personal information or information about the business, commercial, financial or professional affairs of any person if publication would be unreasonable;
  • information that the Office of the Australian Information Commissioner has determined should not be disclosed;
  • information that cannot reasonably practicably be published because of the extent of modifications necessary to delete any of the above information.

A link is provided if the documents can be downloaded from the disclosure log or another website.  If the document is not available for downloading, please request a copy by email to: foi@dfat.gov.au.

In some instances, documents may need to undergo further deletions so they can be released to an individual other than the original FOI applicant.

DFAT’s policy is to upload documents to the disclosure log on the same day as the documents are released to FOI applicants.

There may be documents in the disclosure log that are currently unavailable in an accessible format. If you are unable to access the document in the format provided, DFAT will endeavour to meet all reasonable requests for an alternate format of the document in a timely manner.

I wish to make an application under the Commonwealth Freedom of Information Act 1982 (the Act) for documents held by the Department of Foreign Affairs and Trade (the department) containing information about people believed to be killed during a strike by the U.S. in or around the Syrian city of Raqqa on or around Friday 11 August 2017 (the strike). Those people are Khaled Sharrouf and his sons Abdullah and Zarqawi, who were Australian citizens at the time of their deaths.

Specifically, I seek access to correspondence, notes of meetings, written briefings, written advice, ministerial submissions and/or similar documents, regarding:

  1. the strike and/or planning for the strike;
  2. advice received by the Australian government that Khaled Sharrouf may have died in the strike, and/or a copy of that advice;
  3. advice received by the Australian government that Abdullah and Zarqawi Sharrouf may have died in the strike, and/or a copy of that advice;
  4. Australian government consideration about what role Australia could legitimately play in U.S. operations against Khaled Sharrouf that contained the risk of the deaths of Australian citizens; and,
  5. awareness within the Australian government that the strike had killed or wounded Australian children, and what the consequences of those deaths may be.

I advise I am not interested in duplicate copies of documents or documents that have already been publicly released or media releases, media articles or media statements.

In that story, the foreign minister, Ms Bishop, said she had been informed in October 2013 by officials of "a number of fraud cases under investigation in the Australian aid program."

My request is for the relevant ministerial submissions in DFAT's (or the former AusAID's) possession regarding these fraud cases, including names of the suspected perpetrators, dates, details of the nature of the fraud, locations, actions taken, the estimated amount of the fraud in each case, how much if any was recovered, whether any AusAID or DFAT officials were disciplined or reported to enforcement agencies, and their names.

I similarly seek all relevant ministerial submissions of a case mentioned by Ms Bishop in the story where she says "one has been resolved with the money repaid."
