FOI Disclosure log policy
The Freedom of Information disclosure log is publicly available information released following an FOI access request, as well as other information which the Department elects to release.
The Department of Foreign Affairs and Trade (DFAT) is required under the Freedom of Information Act 1982 to publish a disclosure log on its website. The disclosure log lists information which has been released in response to FOI access requests. This requirement will apply from 1 May 2011.
The disclosure log requirement does not apply to:
- personal information or information about the business, commercial, financial or professional affairs of any person if publication would be unreasonable;
- information determined by the Office of the Australian Information Commissioner (OAIC) not to be disclosed;
- information that cannot reasonably practicably be published because of required deletions to the document.
The information described in the disclosure log has been released by DFAT under the Freedom of information Act 1982 (FOI Act) and is available for public access. Where information is being released outside of the formal provisions of the Act it is identified as such.
A link is provided if the information can be downloaded from the DFAT website or another website.
Charges may be payable to DFAT for the cost incurred in copying or reproducing the information or sending it to you. You will be notified if any charge is payable and required to pay the charge before the information is provided.
There may be documents in the disclosure log that are currently unavailable in an accessible format. If the information is not available on the website or you are unable to access the document in the format provided, DFAT will endeavour to meet all reasonable requests for an alternate format of the document in a timely manner and at the lowest reasonable cost to the applicant.
All format or information enquiries can be directed to the Freedom of Information and Privacy Law Section at the above telephone number or address.
Charges
- Reasonable charges applicable to the re-production of the documents.
DFAT may charge to provide information in another form if the charge is to reimburse the agency for a specific reproduction or incidental cost in providing the information in another way (s11C(4)(b)). Under the current Freedom of Information (Charges) Regulations 1982 the estimated costs for re-production are as follows:
| Format | Charges |
|---|---|
| Photocopying | 10 cents per page |
| Copy (other than photocopy) | $4.40 per page |
| Copy of the document in the form of a computer tape or a computer disk | An amount not exceeding the actual costs incurred by DFAT in producing the copy |
| Copy of the document to be sent to the applicant by post or delivered to the applicant | An amount not exceeding the cost of postage or delivery |
Additional information to be published with FOI releases
- Decision letters and schedules to be published with the released documents – specific FOI requests that add context to the documents released.
DFAT proposes to release a copy of the decision letter and schedule of the documents released under an FOI request. The publication of further detail will assist the public to understand the information made available by DFAT in the disclosure log. For example, the subject or theme that unites a collection of papers may not be readily apparent unless the terms of the FOI request and the scope of the FOI disclosure is explained.
