Explanation of Position: Resolution on the Situation of human rights in Myanmar, November 2023

I deliver this statement on behalf of Australia, Canada, Iceland, New Zealand, Norway, Switzerland, and my own country Liechtenstein.

We thank the EU and the OIC for their efforts in keeping this resolution on the agenda of this Committee. We co-sponsored this important resolution as it remains a key priority for all of our delegations. However, we regret that important elements of agreed language from previous iterations of this resolution have been omitted this year.

This resolution acknowledges that the Rohingya crisis has been exacerbated by the February 2021 coup and the subsequent deterioration of the situation throughout Myanmar. These are inextricably interlinked crises that stem from the same root causes. As such, we strongly support language reiterating the international community's commitment to ending the impunity of the Myanmar military, and working towards the realization of justice.

We remain deeply concerned by the impact of the 2021 coup: the subsequent violations of international humanitarian law and systematic violation of human rights, the negation of human life and human dignity, and the resulting interlinked humanitarian, economic, and political crises. The ensuing regime violence against civilians and minority groups, including but not limited to the Rohingya, and incidents of mass killing, razing of villages, arbitrary detentions, extrajudicial killings, reports of torture, mutilations, the rise in gender-based violence, including conflict-related sexual violence targeting women and girls, the escalating attacks on civilians, including attacks by air and with heavy weaponry, are deplorable. Perpetrators of these crimes must be held accountable.

The supply of weapons to Myanmar is linked to and enabling the escalating conflict and human rights violations since the coup. As called for in UNGA Resolution 75/287, we call on all Member States to take concerted, coordinated, and complementary measures to prevent the flow of arms. We moreover urge Member States to halt the transfer of aviation fuel and revenue to the military regime. We also reiterate our strong support of UNSC resolution 2669, and call for its full implementation. We support the important work of accountability mechanisms such as the Independent Investigative Mechanism for Myanmar, and the ongoing investigation of the ICC prosecutor. We continue to call for full referral by the Security Council to the ICC. We reiterate our support for ASEAN's efforts to promote a peaceful resolution in the interests of the people of Myanmar through the ASEAN Five-Point Consensus and beyond.
