Appellate body upheld the Panel's findings that Japan�s testing requirements
for different varieties of fruit and vegetable products to be inconsistent
with SPS Agreement.

Of commercial export interest for Australian exporters of horticultural
products.

Canada�s local content arrangements related to US/Canada and NAFTA
rules of origin issues. Panel established.

Turkey: Textiles

Turkey�s restrictions on textile imports related to Free Trade Agreement
with EC. Panel found against Turkey. Appellate Body upheld panel's finding
that Article XXIV of GATT does not permit Turkey to adopt, upon the formation
of a customs union with the EC, quantitative restrictions inconsistent
with Articles XI and XIII of GATT.

Major case involving WTO consistency of EC trade arrangements with other
countries. Relevant to WTO Committee on FTAs and to a possible new round
of trade negotiations.

Korea: Dairy Import Arrangements

Australia (joined consultations only)

Korea�s dairy import arrangements. Panel found against Korea. Appellate
Body concluded that Korea had violated Article 12.2 of the Agreement on
Safeguards, reversing in part the panel's findings.�

Korea: Taxes on Alcoholic Beverages

(WT/DS75 and DS84)

Canada, Mexico

General trade interest in taxes on alcoholic beverages. Appellate
Body found Korean measures to be inconsistent with Article III:2 of GATT
1994. Korea has been awarded 13 months to implement.

EC: Asbestos Restrictions

(WT/DS135)

Panel found that French ban on chrysotile asbestos could be justified
under Article XX9d) of GATT 1994. Canada has appealed the findings.

WTO provisions related to protection of human health and technical barriers
to trade.

Relevant to Australia�s existing and projected regulatory arrangements
for chrysotile asbestos.
