Status Report Regarding Implementation of the DSB Recommendations and Rulings in the Dispute Australia – Anti-Dumping Measures on A4 Copy Paper from Indonesia (WT/DS529)

Australia submits this report in accordance with Article 21.6 of the Understanding on Rules and Procedures Governing the Settlement of Disputes.

At its meeting on 27 January 2020, the Dispute Settlement Body (DSB) adopted the Panel report in Australia – Anti‑Dumping Measures on A4 Copy Paper from Indonesia (WT/DS529). On 26 February 2020, Australia notified the DSB of its intention to implement the recommendations and rulings of the DSB through a review of the anti-dumping measures (review of measures) at issue in this dispute, within the framework of Australia's anti-dumping system. Australia also notified that it would require a reasonable period of time to conduct the review of measures. On 12 March 2020, Australia and Indonesia informed the DSB they had agreed on a reasonable period of time for implementation, expiring on 27 September 2020, with an extension of 1 month in the event of unavoidable delays.

As outlined below, Australia has fully implemented the recommendations and rulings of the DSB in this dispute.

On 12 March 2020, the Australian Anti-Dumping Commission (ADC) initiated a review of measures under Division V of Part XVB of the Customs Act 1901 (Cth) for the purpose of implementing the rulings and recommendations of the DSB in this dispute (Review 547).

On 11 September 2020, the Minister for Industry, Science and Technology signed a notice (Anti-Dumping Notice No. 2020/90, published on 14 September 2020), adopting the recommendations and reasons for the recommendations in the ADC's Final Report for Review 547, and declaring that the dumping duty notice be revoked in its application to A4 copy paper exported from Indonesia to Australia by Indah Kiat and Pindo Deli with effect from 12 March 2020, the date of initiation of Review 547.
