Annex 1 Schedule of Tariff Commitments Malaysia

Headnote to Malaysia's schedule of tariff commitments

The tariff lines indicated with the note "TRQ" in the phasing columns of the Schedule
are subject to a Tariff Rate Quota ("TRQ") as specified in Appendix 1 to this
Headnote.

Appendix 1: Tariff rate quotas

  1. Tariff Rate Quota (TRQ) Commitments for Liquid Milk
    1. "Liquid milk" means goods classified to the following Malaysian HS 2012
      Codes: 0401.10.100, 0401.20.100 and 0401.40.110.
    2. Malaysia's commitments on liquid milk are specified in the Appendix.
    3. The tariff quota volumes for liquid milk shall increase from entry into force of
      the Agreement, from the initial TRQ volumes in the first year in Table 1, at the
      following rates:
      1. For HS 2012 0401.10.100 and 0401.40.110: at a rate of 3%
        annually, in perpetuity; and
      2. For HS 2012 0401.20.100: at a rate of 9% annually, in
        perpetuity.
    4. Import licences for these TRQs to be provided on a first-come, first-served
      basis. Details of quota administration will be promptly published, including
      information on procedures for the submission of applications for licences.
      Quota administration will be in accordance with the WTO Agreement on
      Import Licensing Procedures and Article 11 of the Trade in Goods Chapter.
    5. In each year for which tariff quotas apply to HS 2012 0401.10.100 and
      0401.20.100, Malaysia shall administer 35% of each of these annual TRQ
      volumes by an open licensing system, on the basis of the following additional
      conditions:
      1. There shall be no restriction on who can apply for a licence; and
      2. There shall be no restriction on whether product is imported in
        bulk or retail packs.
  2. TRQ Commitments for Other Products
    1. The TRQ commitments for other products are set out in Table 2. The TRQ
      volumes shall increase annually, in perpetuity, at the rates specified in the
      Note to Table 2.
    2. Import licences for these TRQs are to be provided on the basis of the
      following conditions:
      1. Import licences for the TRQs to be issued on a first-come, first-served basis;
      2. There shall be no restriction on who can apply for a licence 1 ; and
      3. Details of quota administration will be promptly published, including information on procedures for the submission of applications for licences. Quota administration will be in
        accordance with the WTO Agreement on Import Licensing Procedures and Article 11 of the Trade in Goods Chapter.

  1. Annual growth rate for TRQs for HS 0203.11.000 is 50% until 2019 and 5% from 2020, in perpetuity.
  2. Annual growth rate for TRQs for HS 0203.21.000 is 8% in perpetuity.
  3. Annual growth rate for TRQs for HS 0207.11.000 is 50% until 2020 and 5% from 2021, in perpetuity.
  4. Annual growth rate for TRQs for HS 0207.12.000 and HS 0207.14.000 is 3% in perpetuity.
  5. Annual growth rate for the other TRQs is 1% in perpetuity.

Appendix 2: Rice

  1. Malaysia's commitments on rice until 2020 are covered in the Schedule.
  2. Following are Malaysia's commitments in the period from 2021:

  3. From 2023 imports into Malaysia from Australia shall be subject to the
    following conditions:
    1. There shall be no restriction on who can import rice including no restriction
      on who can apply for any import licences;
    2. Any import licences shall be issued on a first come, first-served basis; and
    3. There shall be no restriction on whether product is imported in bulk or retail packs.

Appendix 3: approved permits for imports of automotive vehicles

No quantitative limit on imports shall apply to originating vehicles of Chapter
87 of the HS imported from Australia that may be subject to Approved Permits
or any similar import licensing requirement. No additional charges shall be
imposed on imports of such originating vehicles.
